Terms and conditions
These terms apply when you use pawcassoportraits.com and when you buy from us. Please read them before you order. If you are a consumer, nothing in these terms affects your statutory rights.
1. About us
Pawcasso Portraits is a trading name of [registered company name: add it in Settings], a company registered in [country of registration: add it in Settings] with company number [company number: add it in Settings]. Our registered office is [registered office address: add it in Settings]. You can contact us at [contact email: add it in Settings].
2. How your portrait is made
We create your portrait digitally from the photo you send us, in the design you choose. It is not painted or drawn by hand. Each portrait is unique, and while we work to keep your dog's likeness, the result is an artistic interpretation and may differ from your photo in some details.
Before we print or send anything, we email you a proof. Reply to approve it, or tell us what you would like changed. Nothing is printed or sent until you approve it, and we print exactly what you approve.
3. Your photos
You keep all rights in the photos you send us. You confirm that you took them or have permission to use them, and that they do not include anything unlawful or offensive. You give us permission to use your photos only to create your portrait, fulfil your order and keep our service safe. We do not use your photos or portraits in our marketing without asking you first. Our privacy policy explains how long we keep them.
4. Accounts
You can order without an account. If you create one, you can follow your orders and manage your photos in My account. You are responsible for keeping your password and email account secure. You can close your account at any time, except while an order is still being made or has not yet been sent.
5. Prices and payment
Prices are shown in pounds, euros or US dollars, depending on your choice or location. We are not registered for VAT, so no VAT is added and the price you see is the price you pay. UK delivery is included; delivery to Europe has a charge shown before you pay. You pay on our secure checkout page, where payments are processed by Stripe; we never see or store your full card details. The price is fixed when you place your order.
Orders sent outside the UK may be subject to import duties or taxes in the destination country, which are payable by you.
6. Your order
Your order is accepted when we send you an order confirmation email. If we cannot accept your order, or cannot make a portrait from your photo (for example because it is too blurred), we will ask you for another photo or refund you in full.
7. Delivery
Downloads are emailed to you once you approve your proof. Prints and framed prints are posted to the address you give us once you approve your proof. Delivery times are shown on our delivery page and are estimates. The item is your responsibility once it has been delivered to your address.
8. Cancelling, returns and refunds
Prints and framed prints are made to your specification and personalised for you, so the 14-day right to cancel does not apply and you cannot return them because you have changed your mind. When you buy a download, we ask you at checkout to agree that we start making it straight away and to confirm you understand that you then lose your 14-day right to cancel. If you contact us before we have started work on your portrait, we will cancel your order and refund you in full.
Damaged, faulty or incorrect items are reprinted or refunded. Our returns and refunds page explains this in full and forms part of these terms.
9. Discount codes and gift vouchers
Only one discount code can be used per order, and codes cannot be exchanged for cash. Gift vouchers can be spent in any currency we sell in; if you spend one in a different currency, it is converted at that day's exchange rate. Vouchers have no cash value and are not refundable unless the law requires it. A voucher only expires if an expiry date is shown on it.
10. Using your portrait
Once you have paid, you may use your portrait for personal, non-commercial purposes: print it, frame it, share it online and give it as a gift. You may also use a design you buy as the basis for a personal tattoo. You may not sell your portrait, use it to promote a business or sell products featuring it without our written permission.
11. Our responsibility to you
We are responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable, or for losses to a business. We do not exclude or limit our liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, for fraud, or for breach of your legal rights in relation to the goods and digital content you buy.
12. Changes to these terms
We may update these terms from time to time. The terms in force when you place an order apply to that order.
13. The law that applies
These terms are governed by the law of England and Wales, and you can bring legal proceedings in the courts of England and Wales. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts, and if you live elsewhere in the EU, you keep the protection of the mandatory consumer laws of your country.
